LIMITED WARRANTY OF CENTURY INDUSTRIES, INC.
Century Industries, Inc., warrants to the first homeowner wherein its attic stairway product may be installed that the unit will be free from any material defect in parts, components and workmanship for one year following the date of the acquisition of that product. A condition precedent to the effectiveness of this warranty is that the stairway itself must be completely installed in compliance with the provided installation instructions from Century, and it must be solely operated and maintained in accordance with those instructions and in accordance with the additionally provided yellow caution sticker.
This warranty specifically excludes any and all non-defect damage; any and all damage, injuries and losses arising from unreasonable product use; any and all labor charges that are incurred for removing or reinstalling a repaired stairway or any of its component parts; any and all damage, injuries and losses caused by improper installation; and any damage, injuries and losses that arise from the use of the stairway that involves the application of weight to the product which exceeds the specified weight limitations for that product.
If, during the express warranty period, the stairway product or any of its component parts exhibits a defect that would have arisen during the manufacture of the product, please do NOT return the stairway to its place of purchase. Instead, please FIRST CALL our Customer Service Department at (501) 897-5253 and do so BEFORE dismantling the product, and which above-mentioned communication would seek to verify that the alleged problem cannot be corrected. If it is determined that the product or the component was defective as of the time of its manufacture, Century will, at its option, then send reasonably required replacement parts to correct the manufacturing defect, or it will authorize you to return the product to the place of purchase. A proof of purchase is required in either event.
ADDITIONAL EXCLUSIONS AND PRODUCT DISCLAIMERS
Century’s above-stated express limited product warranty is being made in lieu of all implied warranties of any kind or type, including those as provided by the Uniform Commercial Code for merchantability of the product and for fitness of the product for a particular purpose. All such implied warranties, including those of merchantability and/or of fitness for a particular purpose, are excluded and disclaimed. Moreover, all claims for consequential damages and for incidental damages that may arise from a breach of the above-mentioned express warranty are also excluded and, in no event, shall the product manufacturer be liable for any breach of warranty and/or for any negligence and/or for any strict liability and/or for any breach of contract which would exceed in damage amount the cost of the stairway unit itself.
No representative or person is authorized to assume for Century Industries, Inc., any responsibility which would be either in alternative to or in addition to the express product warranty mentioned hereinabove. This warranty gives you certain specific legal rights as were set forth hereinabove and if other rights are conferred they may vary from state to state. Also, if any portion of this express warranty, including its exclusion and disclaimers pertinent thereto, is deemed to be unenforceable at any time hereafter, any such so determined provision shall be severed from this agreement, but all other terms, conditions and provisions hereof shall remain in full force and effect.
